The buyer agrees to read this contract in full, print out this form,sign it, and send it to the seller with there deposit of $500 made out to Michael Humphreys. The seller will sign the contract and give a copy back to the purchaser for their records. The seller agrees to provide the purchaser with the necessary health information, including all shots and de-worming records.

Females will not be breed prior to 18 months of age or their 3rd heat cycle, and males will not be used for breeding before 1 year of age. Breeding rights are non-transferable. If said dog is sold, then a spay or neuter is required. Failure to comply will result in purchaser returning said puppy or dog to the breeder with no refund and purchaser will pay for all costs incurred in breeder getting puppy/dog back (small claims court, transportation, etc.) Buyer understands this and agrees to give said puppy/dog back to seller with no refund if buyer does not get puppy/dog spayed/neutered before selling.

If puppy is sold without breeding rights, puppy must be spayed/neutered by 7 months of age. A copy of the vet statement identifying said puppy/dog must be provided to the breeder stating that said dog has been spayed/neutered. The breeder will hold all registration papers of said puppy/dog until a vet statement has been provided, at that time the breeder will provide the buyer with the registration papers for that puppy/dog. Failure to comply will result in breeder not providing the buyer with registration papers, buyer returning puppy/dog to the breeder with no refund and buyer will pay for all cost incurred in breeder getting puppy/dog back (small claims court,transportation, etc.) Buyer understands this and agrees to return puppy/dog to breeder with no refund if buyer does not get puppy/dog spayed/neutered by 7 months of age. If buyer needs more time due to financial reasons, buyer must contact breeder and breeder may grant an additional 30 days to have spay/neuter performed.

DEPOSITS/PAYMENTS/SHIPPING:
Deposits are $500 and NON-REFUNDABLE. In case of premature death, prior to delivery of said puppy to you, or if the sex of your choice is unavailable you can transfer those monies to a future litter of your choice. IF YOU CHANGE YOUR MIND OR CANNOT PAY FOR YOUR PUPPY, YOU FORFEIT YOUR DEPOSIT. Pups are chosen in order of deposits recieved. Breeder ALWAYS has first pick in all litters. Deposits are to be made in U.S. POSTAL MONEY ORDERS, CASHIERS CHECKS OR CASH ( in person only if making deposit in cash.) Once EMPIRE STATE BULLDOGS has recieved your deposit the puppy will be marked and considered sold. Puppy will be placed on hold for 5 days while we wait for your deposit to arrive. If DEPOSIT is not recieved in the said time frame, that puppy will be placed back up for sale. PUPPY MUST BE PAID FOR IN FULL BY 6 WEEKS OF AGE, FAILURE TO DO SO CAN RESULT IN ADDITIONAL FEES AND OR LOSS OF SAID PUPPY AND NO REFUND WILL BE GIVEN.
EMPIRE STATE BULLDOGS will take care of all shipping arrangements for the buyer at the buyers cost. Shipping for a puppy 20 pounds and under is between $300-$375 at this time. This is an all inclusive shipping cost and it includes your crate, vet check and actual shipping costs. Any puppy not picked up in person or shipped after the 10th week of age will have additional boarding fees of $50 per week unless prior arrangements have been made in writing between EMPIRE STATE BULLDOGS and the buyer. The buyer will also be responsible for any additional vaccinations De-wormings and any neccesary vet care while the puppy is still under our care.
YOUR EMPIRE STATE BULLDOGS PUPPY IS GUARANTEED AS FOLLOWS:
1. To be in good physical condition at the time of delivery to you the buyer. The buyer agrees to have the puppy examined by a LICENSED VETERINARIAN within 3 buisness days for a complete physical examine. If the vet finds the puppy to have a serious physical condition other than a bacterial infection, such as coccidia, or giardia, which is easily treated, the breeder will replace the puppy with another puppy of comparable quality when available either from the same litter or a future litter, AFTER, the first puppy has been returned to the breeder.
2. To be free of any genetic/hereditary defects that cause death or serious impairment of vital functions of the said puppy until 6 months of age: If such an inheritable defect is documented by the vet and is presented to the breeder with sufficient supporting evidence, the buyer will be entitled to a replacement puppy of comparable quality, when available from an upcoming litter, AFTER, the first puppy is returned to the breeder.
3. Puppy will have up to date vaccinations and De-wormings. No replacements will be given in case of PARVO. This guarantee does not cover what we consider to be normal problems for the bulldog breed or problems beyond our control such as: CHERRY EYE, ENTROPIAN, LOOSE HIPS, OR SKIN ALLERGIES SUCH AS MANGE. We are not geneticists and cannot predict genetic problems. We do not breed dogs with undesirable conditions such as mange or bad hips but we cannot guarantee that previous generations from other breeders did not have these conditions in there lines. Therefore we cannot guarantee that the dog will not contract mange ( red mange, demodex mange, or any type of mite mange. ) Mange is a multi-factorial genetic disease that can be transmitted in a recessive manner. There is a great deal of disputes amongst experts as to the differing specific causes of mange including but possibly not limited to: Environmental conditions, stress and nutrition, therefore we cannot guarantee against it.
GUARANTEE IS VOID IF THE PUPPY IS NOT EXAMINED BY A LICENSED VET WITHIN THE THREE BUISNESS DAYS OR IN CASES WHERE THE DOG IS BEING USED IN ILLEGAL ACTIVITYS SUCH AS DOG FIGHTING OR EXTREME SPORTS SUCH AS WEIGHT PULLING, OR IS MISTREATED, MALNOURISHED OR ABUSED.GUARANTEE IS ALSO VOID IF DOG IS BREED BEFORE I YEAR OF AGE. GUARANTEE IS NON-TRANSFERRABLE IF DOG IS SOLD BY BUYER. ANY KNOWN ABUSE OR ILLEGAL ACTIVITY WILL RESULT IN LEGAL MATTERS AND BREEDER WILL TAKE PUP/DOG BACK AND CONTINUE WITH LEGAL ACTIONS.
It is understood that at the time of this sale the puppy is not considered to be of show or breeding quality, but is represented as it's breed and is suited as pet quality only. There is no guarantee or warranty that the buyer will be able to breed or show the pup/dog purchased, regardless of show/breeding potential. This guarantee is void if the pup/dog has been breed, altered, transferred or euthanized without the breeders written consent.
BUYER AGREES TO THE FOLLOWING:
1. TO USE " ESB" as a prefix in the registration of the puppy/dog.
2. Maintain up to date vaccinations, wormings, and keep the puppy/dog in humane conditions providing love, proper food, water and shelter for the puppy/ dog at all times.
3. If by chance you are unable to keep your puppy/dog EMPIRE STATE BULLDOGS has first rights to reclaim the puppy/dog or we will help you to rehome the puppy/dog. NO REFUND IMPLIED...
4. If breeding rights have been givin puppy is NOT to be bred before 1 year of age.
The buyer and seller agree that this is the full and complete agreement that exists between the parties for the sale of this puppy/dog. Any agreements made prior to this are considered incorporated into this contract and any other modifications made to this agreement shall be made in writing or such shall not be effective. By signing this agreement you agree to all of the above. This agreement is a legal contract and must be signed by the buyer and returned to the breeder.
